Why is Kasab not getting the punished?

There has been a debate for a while for Indian government not giving any punishment to only alive accused of 26/11. Why do you think that such a delay? Well all of us know through video footage and various other sources that he was one of the 10 terrorists who had attacked Mumbai with open firing and grenade but still no act from the judiciary system.

There are many reasons to it, we have to give a fair trial to Kasab. As pointed by minister Shashi Tharoor, that let the judicial system take its course. If you see the incident, there are 86 charges which have been framed against Kasab and as per our judicial system those must be proved against him. If we become unsuccessful in proving a few of the charges then the judicial unproved charges have to be proved against someone else otherwise an inquiry or intelligence has to do its work to find out a new accused in such a scenario.

We also need to show it to the world that we have an independent judiciary, that doesn’t get swayed by mobs baying for blood. It’s important not just to show Pakistan that their citizen, captured by us, will receive the best legal defense here even though he was videotaped and witnesses have seen him killing people. Fundamentally we are a democratic nation with our judicial system built to believe on proofs and provide justice to all. Fundamentally we can not act like an autocratic or cleric judiciary where things are also decided by the perception of the judge.

Take the case when camera had caught mob in case of Godhra attacks or those during Mangalore pub attacks by Shri Ram Sena activists, we did not directly gave a verdict against these. So it is for us to decide what do we want our judicial system to be like, if it has to act in a manner in small cases of crime then it has to act in the same way with larger criminal cases. There can be no other way.

Also such trial would bring in more information from Kasab and throw lights on the security loop holes that our system has; as this is the only chance to surface those areas and make it public.

I am talking about lacuna in the security system, intelligence information gathering and many others. Like in the case of Headley and Rana the American intelligence is being able to give stories and News on Daily basis about their plots but against it our intelligence is not so well equipped with information to link up or bridge the information in bits and pieces.  So I believe in a democratic approach but to make effective we would need very good and uncorrupted army of officers and people.
